1. Acceptance of Terms

By accessing or using the Site, creating an account, or purchasing any product or service (collectively, the “Services”), you agree to be bound by these Terms and by our Privacy Policy below. If you do not agree, do not use the Services.

2. Eligibility & Accounts

  • You must be at least 18 years old (or the age of majority in your jurisdiction) to make a purchase.

3. Product Listings, Availability & Fitment

  • We strive to be accurate, but product descriptions, images, specifications, or pricing may contain errors or omissions. We reserve the right to correct any errors and to change or update information at any time without prior notice, including after you submit an order.
  • Fitment/Compatibility: Ensure compatibility with your vehicle before purchase. Unless explicitly stated, products are not OEM parts. Customer is responsible for verifying fitment with the manufacturer or a qualified professional.
  • Colors and finishes may vary due to device displays or manufacturing batches.

4. Pricing, Taxes, Promotions & Errors

  • Prices are in U.S. dollars unless stated otherwise and exclude taxes, shipping, and handling. Applicable taxes will be calculated at checkout.
  • We may modify prices or promotions at any time. Promotional codes are subject to separate terms and may be limited to one per order.
  • If a product is listed with an incorrect price or information due to error, we may cancel orders and refund you, even after order confirmation.

5. Orders, Acceptance & Cancellations

  • Your order is an offer to buy; we accept only when we ship the product(s) or otherwise confirm acceptance. Automated emails acknowledging an order are not acceptance.
  • We may reject any order for reasons including suspected fraud, product unavailability, pricing errors, or compliance concerns.
  • Cancellations: Contact us promptly to request cancellation. If the order has already shipped, you must follow the Returns process below.

6. Payment & Fraud Screening

  • We accept major payment methods (e.g., credit/debit cards, Shop Pay, PayPal, etc.) processed by third-party payment processors. We do not store full card numbers.
  • Orders may be delayed or canceled pending ID verification or fraud checks. Unresolved chargebacks or payment disputes may result in account termination.

7. Third‑Party Financing (Optional)

  • We may offer financing through third-party providers (e.g., Affirm, Acima, Snap Finance). Financing is subject to the provider’s approval and separate terms.
  • By applying, you authorize us and/or the provider to obtain, receive, and share information to process the application.
  • Important: Financing decisions, payment schedules, interest, and fees are solely determined by the financing provider.

8. Shipping, Delivery & Risk of Loss

  • Handling Time: Orders typically ship within [1–3] business days, excluding weekends and holidays.
  • Carriers: We ship via common carriers (e.g., UPS, FedEx, USPS, DHL). Shipping options and costs are shown at checkout.
  • Address Accuracy: You are responsible for providing a complete and accurate shipping address; changes after shipment may not be possible and may incur carrier fees.
  • Risk of Loss: Title and risk of loss pass to you upon our delivery to the carrier. Once the carrier shows “Delivered,” the package is deemed delivered to you.
  • Signature/Insurance: For high-value orders, we may require signature confirmation or offer optional insurance at checkout.
  • International Shipping: You are responsible for customs duties, taxes, brokerage fees, and import compliance. We cannot guarantee delivery timelines impacted by customs clearance.
  • Delivery Issues: If tracking shows “Delivered” but you did not receive your package, contact the carrier and us within 48 hours. We may assist but are not responsible for theft or misdelivery after carrier confirmation of delivery.

9. Backorders & Pre‑Orders

  • Estimated ship dates are good‑faith estimates and may change. You may cancel a backorder or pre‑order for a full refund prior to shipment unless stated otherwise.

10. Returns, Exchanges & Refunds

  • Return Window: Most new, unopened items may be returned within 30 days of delivery for a refund.
  • Non‑Returnable Items: Installed/used items, special orders, clearance items, cut wire, opened audio accessories (e.g., wiring kits, sound deadening) and any item not in original packaging may be non‑returnable for hygiene/safety reasons.
  • RMA Required: Obtain a Return Merchandise Authorization (RMA) by contacting [returns@supercaraudio.com]. Returns without an RMA may be refused.
  • Condition: Items must be in original condition with all parts, accessories, manuals, and packaging.
  • Restocking Fee: A 15% restocking fee may apply to opened packages or returns due to buyer’s remorse.
  • Return Shipping: Customer pays return shipping unless the return is due to our error or a verified defect on arrival (DOA).
  • Refund Timing: Approved refunds are issued to the original payment method within 5–10 business days after receipt and inspection.
  • Exchanges: Subject to availability; otherwise a refund will be processed.
  • DOA/Shortage Claims: Report within 7 days of delivery with photos/videos. Keep all packaging.

11. Warranties & Disclaimers

  • Manufacturer Warranties: Many products are covered by the manufacturer’s limited warranty; terms vary. We facilitate claims where possible but final decisions rest with the manufacturer.
  • INSTALLATION & USE: Some products require professional installation. Improper installation can cause damage, fire, or injury. You assume all risks related to installation or modification.
  • TINT/NOISE/ROAD‑USE LAWS: You are responsible for compliance with local laws regarding window tint, lighting, and sound levels.
  • AS‑IS DISCLAIMER: EXCEPT AS EXPRESSLY PROVIDED BY A MANUFACTURER’S WRITTEN WARRANTY, THE PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, ARISING OUT OF OR RELATED TO THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

You agree not to: (a) use the Services for unlawful purposes; (b) interfere with or disrupt the Site; (c) bypass security; (d) engage in fraud or resale of counterfeit goods; (e) submit unlawful, defamatory, or infringing content; or (f) use data mining/scraping without our prior written consent (except as permitted by robots.txt).

14. Intellectual Property; User Content

  • If you post reviews or content, you grant us a worldwide, royalty‑free, perpetual license to use, reproduce, display, and distribute such content in any media.

  • Reply STOP to cancel, HELP for help. We may use carriers and SMS providers (e.g., Twilio/Klaviyo/SMSBump). Carriers are not liable for delayed or undelivered messages.

17. Export & Sanctions Compliance

You may not use or export products in violation of U.S. export laws and regulations. We do not ship to embargoed countries or prohibited end users.

  • Class Action Waiver: YOU AND WE AGREE THAT ANY PROCEEDINGS SHALL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
